UK Court Ruling Opens Door for New Tax Status on Works of Art

Sunday, April 7th, 2013

A UK tax judgement this week has challenged the taxation of art works in the country, allowing Portrait of Omai by Sir Joshua Reynolds to be taxed as a “wasting asset,” thereby avoiding capital gains tax.  The painting had hung in North Yorkshire’s Castle Howard for over two hundred years, and was recently sold by owned Simon Howard, who claims the work contributed to the appeal of the castle for tourists.  “The case could give vendors savings of 28 per cent on the sale of works of art that fulfil the same criteria,” said art agent Robert Holden. Juergen Teller, Installation View, via The ICA

Juergen Teller leads a life that is far from the norm in fine art. Despite his ubiquitous gallery shows and openings, Teller also embraces the commercial world of photography; touring with rock stars and shooting celebrities around the globe. Regardless, the photographer has always been regarded as the ‘antithesis’ of what should constitute conventional Haute Couture photography.  In order to illustrate the artists distinctive and breathtaking style, the ICA in London is currently presenting a retrospective covering the broad expanse of Teller’s career, along with recent works that steer away from the limelight of his previous glossy campaigns and focus on more subdued topics such as portraiture of his family and friends.

If somebody chooses to spend it on mortgage payments, then those mortgage payments would become art, which is quite miraculous to me.”  He says. (more…)
